There have been occasional sentences of a year or two behind bars, for people who tried to buy a gun when they were a felon prohibited from having one. ![]() Most prosecutions result in guilty pleas to misdemeanor offenses, and sentences of probation and a fine, the report said. The majority of cases are not prosecuted for the same reason the ATF cited: the difficulty of proving someone “knowingly and willingly” lied on the form. State police told the GAO they believe investigations deter future attempts to buy a firearm. In fiscal year 2017, they investigated 5,465 cases and filed charges against 842 people, 472 of whom were convicted. Since 2014, every purchase rejected by the system has been investigated by state or local police, according to the GAO report. ![]() Pennsylvania doesn’t rely on the feds and is among the states that do their own background reviews, by state police. That person now is facing felony charges, according to the GAO report. ![]() It’s good that they do because they recently found a convicted murderer tried to buy a gun.
